The Sedona Conference Commentary on Privacy and Information Security: Principles and Guidelines for Lawyers, Law Firms, and Other Legal Service Providers

The Sedona Conference is tackling the bad guys. Cyber-thieves who steal identities, trade secrets, and other sensitive information are targeting lawyers, law firms, and legal service providers who hold information about their clients and others. In its newest publication, The Sedona Conference Commentary on Privacy and Information Security: Principles and Guidelines for Lawyers, Law Firms, and Other Legal Service Providers, the Sedona Conference sets out principles and practical guidance for everyone—from solo practitioners and large law firms to expert witnesses and legal support firms—for protecting the sensitive personal and confidential information they handle while providing legal services.
This Commentary begins by describing the security challenges faced by lawyers and legal service providers in today’s interconnected world. It identifies the major sources of a provider’s duty to protect private and confidential information. It then describes a process by which legal service providers may conduct thorough security risk assessments that take into account the information they possess, the vulnerability of that information to unauthorized disclosures, breaches, loss, or theft, and the way in which providers can mitigate those threats. Finally, this Commentary delves into various policies and practices that can address privacy and information security, setting forth processes that each practitioner and service provider can scale to meet its particular needs and circumstances.
